1. Introduction

1.1 These Terms & Conditions (“Terms”) govern your use of the websites, mobile applications, online platforms, and classroom / hybrid programs of SMARTMOVE LEARNING PRIVATE LIMITED (“SMARTMOVE”, “we”, “us”, “our”).

1.2 By registering, creating an account, accessing any content, or enrolling in any course (online, offline or hybrid), you (student and/or parent/guardian) agree to these Terms, our Privacy Policy, Pricing Policy, Digital Delivery (Shipping) Policy, and Cancellation & Refund Policy (collectively, the “Policies”).

1.3 If you do not agree with any part of these Terms or Policies, you should not use our Services or proceed with admission.

2. Eligibility & Parent/Guardian Consent

2.1 Students below 18 years must enroll with the consent and supervision of a parent/guardian. The parent/guardian will be treated as the contracting party for fee payment and legal matters.

2.2 You confirm that all information given at the time of enquiry, registration or admission is true, complete and accurate. Misrepresentation may lead to cancellation of admission without refund.

3. Services & Hybrid Mode

3.1 SMARTMOVE offers educational services including:

1. - Offline classroom coaching at our centers;
2. - Live online classes;
3. - Recorded lectures;
4. - Online tests, question banks and doubt support;
5. - Hybrid programs combining both offline and online components.

3.2 The structure (online vs offline mix), batch schedule, faculty allocation and duration may vary by course and may be modified for academic or operational reasons.

3.3 Access to online content is time-bound and limited to the duration communicated at the time of admission or on the course page.

3.4 You are responsible for arranging your own devices, internet connection and data for accessing online/hybrid services.

4. Account Registration & Security

4.1 To use our online/hybrid services, you may need to create an account using your mobile number, email or other credentials.

4.2 You agree to:

1. - keep your login ID and password confidential;
2. - not share your account with any third person;
3. - inform us immediately in case of any suspected unauthorized use.

4.3 SMARTMOVE may suspend or terminate accounts used for sharing credentials, impersonation, misuse or violation of these Terms.

5. Student Conduct & Discipline (Online & Offline)

5.1 Students must maintain discipline and respectful behavior inside the institute, during online sessions and on any platform associated with SMARTMOVE. Misconduct includes (but is not limited to):

1. - harassment, abuse or disrespect towards teachers, staff or other students;
2. - damaging property or classroom infrastructure;
3. - creating disturbances in sessions (online or offline);
4. - posting or sharing obscene, offensive, defamatory or illegal content;
5. - recording, downloading or circulating classes or content without permission;
6. - using SMARTMOVE's name, logo or identity to mislead others or for personal gain.

5.2 Spreading rumors or defamatory/negative content about SMARTMOVE, its staff or students on social media or messaging platforms may be treated as serious misconduct.

5.3 Disciplinary action for violations can include warnings, suspension from classes, temporary or permanent blocking of online access, withdrawal of scholarships, and cancellation of admission without refund.

6. Attendance, Punctuality & Academic Integrity

6.1 Regular attendance in classes and tests (online or offline) is essential for academic progress.

6.2 Habitual absenteeism, long absence without intimation, or consistently missing tests may lead to:

1. - withholding of results;
2. - suspension from classes;
3. - cancellation of admission as per internal rules and the Cancellation & Refund Policy.

6.3 Students must maintain integrity in all exams, including weekly tests, mock tests, scholarship tests and SMARTMOVE Talent Search exams. Use of unfair means, impersonation, copying or attempting to tamper with test systems will result in disqualification and may lead to rustication.

6.4 For online exams, we may use proctoring tools (webcam, microphone, activity monitoring) strictly for exam integrity and security.

7. Fees, Instalments, Scholarships & Taxes

7.1 Course fees, instalment options, due dates and applicable taxes will be displayed on our website, prospectus or admission form and are governed by the Pricing Policy.

7.2 All fees are subject to applicable taxes (including GST). If tax rates change, the difference for unpaid or future instalments will be payable by the student/parent as per law.

7.3 Scholarships, discounts or concessions (if any) are:

1. - subject to eligibility criteria announced for each scheme;
2. - conditional on submission and verification of required documents;
3. - confirmed only after written approval from SMARTMOVE.

7.4 Scholarships or discounts may be withdrawn for prolonged absenteeism, fee default, or disciplinary issues.

7.5 Fee transfer, course change, and refund rules are governed by the Cancellation & Refund Policy.

8. Intellectual Property & Use of Content

8.1 All content, including lectures, notes, tests, question banks, videos, PDFs, graphics, logos and software, is owned by SMARTMOVE or its licensors.

8.2 You receive a limited, non-exclusive, non-transferable license to access the content only for your personal learning during the course.

8.3 You agree not to:

1. - copy, screen-record or distribute content in bulk;
2. - upload our content to any website, app, social media or file-sharing platform;
3. - use our content to run or assist any competing coaching service.

8.4 Violation of intellectual property rights may lead to termination of access and legal action.

9. Recording, Publicity & Promotions

9.1 Classes (online/offline) may be recorded for quality, academic analysis, or content development.

9.2 SMARTMOVE may use student names, photos, ranks, results and testimonials in marketing and publicity materials (print, digital, social media), subject to applicable law and consent choices under the Privacy Policy.

9.3 If you wish to restrict future marketing use of your name or photo, you may email us at [info@smartmovelearning.com]. This will not affect use already completed lawfully.
